What do you think the basis for legal action would be? What law did they
break?
I think this is only an ethical issue and not a criminal one, ... or a
violation of a contract where civil action could be taken..
From the way Jerry M stated the problem, I gather that there was no signed
contract stating anything about competition or trade secrets.
As someone else suggested, I think it would be wise to draw up an agreement
prohibiting an employee from working with a competitor or disclosing
customer information for a couple of years after employment. (The legality
of this may vary in different states.)
