Romans 8:2 seems to me to make it clear that he is NOT
talking about the same reality but rather contrasting
two positions: Slaves of sin 7:14 with slaves of
righteousness 6:18.

Romans 8:1 "There is therefore now..." While he shows
what was with what now is.

Hopefully being married to a different husband 7:2-3
is not the same reality! So also there is a different
reality in being in Christ than being under the law.
