I think we're on the same page.  But Exodus 21-23 is post-ratification, not pre, since the Ten Commandments are mentioned first in chapter 20.

As Hebrews treats "the Old Covenant", yes, absolutely. In fact, don't hear 
me to say that the Ten Commandments event isn't THE significant covenant/law 
event of the Old Testament. It is. My only point was to suggest that the 
ratification is inclusive of the 613.

My qualification of the above is that I'm not ready to suggest that Hebrews' 
specific use of "Old Covenant" as the Mosaic Covenant extends to all uses of 
"Old Covenant". i.e. I think there are times when it is possible to speak of 
the New Covenant over against the Old Testament as Old Covenant, esp. as it 
relates to the question "*what* did Christ fulfill?".
